Traders Terms

Terms and Conditions for all Christmas Market Traders at I BELIEVE™ In Christmas Dublin:

1. All traders must carry their own Public and Product Liability Insurance. All traders must also carry employer’s liability (where applicable). Please ensure I BELIEVE™ are indemnified on your policy.  Traders are liable for any loss or damage to the market or equipment caused by their negligence.
2. All traders must comply with fire regulations and ensure that all materials used within their pitch are certified flame retardant. No naked flames or own generators will be permitted.
3. Food traders must adhere to EHO regulations, Food Safety regulations and have the relevant certification and training completed for all staff.
4. Any trader using electrical equipment must provide PAT and RECI certification where relevant. No 13 amp plugs will be allowed.
5. The Market Manager reserve the right to limit the number of stallholders offering similar products and/or food and do not offer exclusivity to any one trader.
6. Stalls are allocated by the Market Manager and this is not negotiable.  Any trader attempting to move pitch or swap pitch, without the consent of the Market Manager, will have their pitch removed and will not receive any refund of pitch fees.  
7. Temporary occupation of the trading area does not create or establish any right, lease, agreement, contract or easement on that area and the stall holder is subject to removal and movement from any position within the market to any other position the Market Management may decide.
8. Traders are permitted to sell the items listed upon their application only and in agreement with the Market Manager.  Any additional items must be approved by the Market Manager before adding to the pitch.
9. I BELIEVE™ reserves the right to seek proof of purchase/sales invoice in respect of goods on offer from any market trader, especially in relation to suspected counterfeit or unethical goods.  Explosive or dangerous goods, including fireworks, are strictly prohibited.
10. Upon arrival to the site, all traders MUST check in with the Market Manager and wait to be sited by a member of the crew.
11. Conduct of Business – Traders shall conduct themselves and their business in such manner as to maintain the good order, discipline and reputation of the market.  All staff on site should have sound knowledge and passion for your products and your business.
12. All staff names must be supplied to the Market Manager prior to their arrival on site so as to ensure site security have accurate information and allow only designated staff to your pitch.
13. Traders are required to be open and operational during the market opening hours and are required to cease trading outside of these hours. With the exception of extenuating circumstances agreed with the Market Manager, failure to operate during the opening hours in full will incur the pitch space being reallocated to another vendor and no refund of pitch fees.
14. NO VEHICLES will be allowed ON SITE. Access will be available for deliveries at designated times only (as per specific instructions to traders which you will receive prior to arrival). Vehicles illegally parked around the site of The CHQ Building will be removed by Dublin City Council clampers.
15. Vehicles on site during the set-up and take down of the Market will only be allowed access under the supervision of the site manager.
16. Traders that have “sold out” before the official loading times will be allowed to trolley their stock from their vehicle but they may not bring their vehicle on to the site.
17. Refuse – Traders are responsible for removing and disposing of all their waste material to the allocated skips and for keeping their designated area litter free. Traders who leave waste on site will be permanently banned from the market. Waste MUST be separated into Recyclable, Food Waste and General Waste. All waste water must be properly disposed of.
18. By law, no smoking in the units or under and around canopies is permitted by traders or customers.
19. All escape routes from stalls to be kept unobstructed and free from trip hazards.
20. All vendors must follow any instruction given by the Fire Officers, Market Manager and Manager of The CHQ Building in relation to safety protocols.
21. Portable LPG heaters are prohibited
22. Traders are obliged to dress their units in a way that is in keeping with the general décor of the event and are not permitted to play music or unduly create noise.  The vendor package must be confirmed 30 days prior to the event commencing with the design partners.  The basic package is included in the rate of the pitch space.
23. Traders are obliged to clearly display prices of products on sale and visible to all potential customers.  All food labelling must comply with the most recent EU standards where applicable.
24. Any accidents, unresolved disputes, thefts, losses, disorderly conduct or damage must be reported to the Market Manager without delay.
25. Traders are responsible for all their own equipment. I BELIEVE™ and the CHQ Building are not liable or responsible for any display items or stock left behind by traders on each day of the market.
26. Anti-social behaviour will mean instant dismissal from the market.
27. Traders drawing power will be given one connection point on the distribution board and will need to bring their own out-door extension leads (min 20m) which has been PAT tested.  All electrical equipment used must also have been PAT tested prior to arrival, and in the last 12 months.
28. Payments are charged as per the rate card and VAT @ 23% applies
29. Payment in full of pitch fee is required prior to arrival on site and by the invoice date.  Failure to do so will mean that the site will be allocated to another vendor on the waiting list.

I BELIEVE™ and The CHQ Building Management reserves the right to review stall allocation at any time and to amend the terms and conditions.  I BELIEVE™ and The CHQ Building is obliged to give names and addresses of traders to relevant authorities upon request.
